Is your nonprofit ready for the new overtime rules which will become effective on December 1, 2016? The Department of Labor’s final overtime rules update the salary level required for the executive, administrative, and professional (“white collar”) exemption to ensure that the Fair Labor Standards Act’s (FLSA) intended overtime protections are fully implemented. It also provides greater clarity for white collar workers and their employers, including nonprofit organizations. Neither the FLSA nor the Department’s regulations provide an exemption from overtime requirements for nonprofit organizations. While some nonprofits may not be covered under the FLSA, it is likely that many employees of nonprofits are entitled to FLSA protections.
