Please RSVP by December 8. \nPresenter: David Emer\, Nutter McClennen & Fish LLP \nEvent Update as of 12/2/2016: \nOn November 22\, the United States District Court for the Eastern District of Texas issued a preliminary injunction that blocks the implementation of the United States Department of Labor’s Final Rule that redefined the wage test for overtime exemptions under the Fair Labor Standards Act. The Final Rule was to be effective on December 1\, and would have required employers\, including nonprofits\, to pay overtime to all so-called “white collar” executive\, administrative\, and professional workers earning less than $913 per week ($47\,476 annually). The court’s order applies nationwide. In issuing the injunction\, the court concluded that the states’ and business associations’ challenge to the Final Rule has a substantial likelihood of success on the merits\, and the states and business associations would be irreparably harmed if the Rule was implemented. \nWhat Is the Impact on Employers? \nThe nationwide injunction has created a great deal of uncertainty. The injunction is preliminary and not permanent at this point\, and an appellate court might overturn the ruling. However\, President-Elect Trump criticized the Rule during his campaign for President and expressed support for a carve-out for small business. Thus it is possible that the Trump administration would not pursue an appeal. \nWhat does this uncertainty mean to your nonprofit? What should you do with the preparation for implementation that is already in place? What about all the consultation you had with the employees about the new system? Did your nonprofit talk about changing the payment structure with individual employees? This seminar may be attended in person at DLA Piper or remotely via videocast. \nIn May\, the Department of Labor published new regulations that change the rules regarding which employees are eligible for overtime pay. Beginning December 1\, 2016\, employees who earn less than $913 per week ($47\,476 per year) are automatically eligible for overtime pay when they work more than 40 hours a week\, regardless of what their job duties are. Only doctors\, lawyers\, teachers\, and a few other classes of employees are not subject to this new rule.
